STATE OF FLORIDA Plaintiff, VS. JOSE ENRIQUE RIVERA COTTO Defendant. IN THE CIRCUIT COURT OF THE NINTH JUDICIAL CIRCUIT, IN AND FOR OSCEOLA COUNTY, FLORIDA CASE NO: 49-2026-CF-000008 DIVISION: 12-A STATE'S MOTION FOR PRETRIAL DETENTION COMES NOW the State of Florida and moves this Court pursuant to Florida Statute § 907.041(5) and Florida Rule of Criminal Procedure 3.132(a) to order the continued detention of this defendant without bond pending trial. As grounds therefor, the State alleges: 1. Pursuant to Florida Statute § 907.041(5)(a)(5), the defendant is charged with the following dangerous crime: Domestic Battery by Strangulation in violation of Florida Statute § 784.031(1). 1. Pursuant to Florida Statute § 907.041(5)(c), in pertinent part: Upon motion by the state attorney, the court may order pretrial detention if it finds a substantial probability, based on a defendant's past and present patterns of behavior, the criteria in s. 903.046, and any other relevant facts, that any of the following circumstances exist: 5. The defendant poses the threat of harm to the community. The court may so conclude, if it finds that the defendant is presently charged with a dangerous crime, that there is a substantial probability that the defendant committed such crime, that the factual circumstances of the crime indicate a disregard for the safety of the community, and that there are no conditions of release reasonably sufficient to protect the community from the risk of physical harm to persons. 2. There is a substantial probability that the defendant committed the dangerous crime charged. Among the facts and evidence that show a substantial probability that the defendant committed this crime are: a. In his sworn charging affidavit, Deputy Elias Ramirez of the Osceola County Sheriffs Office stated that on January 1, 2026, he interviewed the victim of the aforementioned crime, Ms. Yencelis Collazo, who advised as follows via sworn verbal and written statements: i. Ms. Collazo and Mr. Rivera Cotto have been dating for two years and share a one-year-old child in common. They reside at the same address in Osceola County, Florida. ii. In the early morning hours of December 31, 2025, Ms. Collazo and Mr. Rivera Cotto's child awoke crying. ili. Mr. Rivera Cotto checked on the child and became irritated due to the child's crying. Mr. Rivera Cotto then returned to the couple's bedroom to yell at Ms. Collazo, demanding that she care for the child, so he could sleep. v. Ms. Collazo and Mr. Rivera Cotto then entered a back-and-forth of Ms. Collazo • trying to calm the child and Mr. Rivera Cotto becoming increasingly irate due to the baby's continued crying. vi. Mr. Rivera Cotto then grabbed Ms. Collazo's neck, restricting her breathing. After being released, Ms. Collazo began to cough. vii. Ms. Collazo then fled the home and ran to her vehicle where she locked herself inside. viii. Mr. Rivera Cotto then chased after her, climbing on the hood of the vehicle. He then struck the windshield repeatedly, causing it to crack. He then tore off the windshield wipers while yelling, "Im going to kill you," putting Ms. Collazo in fear. b. While on scene, Deputy Ramirez observed a small, red mark on the right side of Ms. Collazo's neck. c. Additional evidence may be adduced at the hearing on this motion. 3. Among the circumstances that show that there are no conditions of release which will reasonably protect the community from a risk of physical harm, ensure the presence of the defendant at trial, or assure the integrity of the judicial process: a. In her sworn statement to law enforcement, Ms. Collazo advised that a few days prior to the aforementioned incident, Mr. Rivera Cotto choked Ms. Collazo and dug his nails into her leg. Consequently, Deputy Ramirez observed a black-and- blue bruise on Ms. Collazo's right leg. b. In terms of criminal history, the defendant has the following prior record: i. Possession of Oxycodone (2023) ii. Driving Under the Influence (2023) iii. Leaving the Scene of a Crash Involving Property Damage (2023) c. Given Mr. Rivera Cotto's willingness to harm those closest to him, potentially in the presence of an infant, the public is at risk of physical harm should Mr. Rivera Cotto be released pending trial. d.
